Law 12/2023 of May 24, regarding the right to housing, was approved in Congress on April 27, 2023, and in the Senate on May 18, 2023, and has been in effect since the day following its inclusion in the BOE on May 26, 2023. This law states in Section 1 of Article 20 that, in the case of residential lease contracts, the costs of real estate management and contract formalization will be borne by the landlord. This regulation does not apply in cases of lease contracts for uses other than housing, such as commercial premises, and specifically does not apply to seasonal lease contracts. In these cases, the tenant pays one month of the agency fees along with the corresponding IGIC.
